Provisionary Attachment Order Granted by Court against Lumens
AVerMedia Announces Digital ATSC Dual Hybrid TV Tuner at the 2004 Intel Developer Forum
Taipei, Taiwan, January 31st, 2005 – AverMedia Technologies Inc. (TSE:2417) announced today that a Provisionary Attachment filed by AVerMedia was granted on January 3, 2005. The Provisionary Attachment Order was later enforced by Taiwan HsinChu District Court against Lumens Digital Optics, Inc. on January 31, 2005. Lumens is a Taiwanese manufacturer of digital imaging products. Based on the patent infringement assessment report issued by National Taiwan University (NTU), Lumens’ sales of Digital Visual Presenter DC 150 may infringe AVerMedia’s patent.
This Provisionary Attachment Order was granted primarily based on the patent infringement assessment report made by NTU, a prestigious university and government certified patent infringement assessment institution. NTU confirmed that the Digital Visual Presenter DC 150 manufactured and sold by Lumens infringed upon AVerMedia’s issued Taiwan Invention Patent No.472169, entitled “An Image Capture Device With A Boundary Indicator”.
Regardless of numerous cease and desist letters sent by AVerMedia requesting Lumens to end the manufacturing and sales of products related to the patent infringement, Lumens has continued all activities regarding the DC 150, thus forcing AVerMedia to initiate relevant legal action.
AVerMedia will continue to protect and foster its intellectual property and will defend all potential infringements.
